Oct 28 - Privacy Act of 1974; Notification of the Establishment of a Privacy Act System of Records, HUD Integrated Acquisition Management System (HIAMS)

HUD proposes to establish a new record system to add to its inventory of system of records subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended. The proposed system of records, identified as HIAMS will be used by HUD's Office of the Chief Procurement Officer, as well as HUD's regional program offices, to store and manage HUD acquisition-related data from acquisition planning through contract completion. The regional offices will have access to HIAMS for the purposes of entering and reading data into the system. The system will consist of data elements about all companies or institutions authorized to do business with HUD as registered vendors within the Central Contractor Registry (CCR), overseen by the General Services Administration.

Oct 28 - Buy American Exceptions Under the American Recovery and Reinvestment Act of 2009

In accordance with the American Recovery and Reinvestment Act of 2009 (Pub. L. 111-05, approved February 17, 2009) (Recovery Act), and implementing guidance of the Office of Management and Budget (OMB), this notice advises that certain exceptions to the Buy American requirement of the Recovery Act have been determined applicable for work using Capital Fund Recovery Formula and Competition (CFRFC) grant funds. Specifically, exceptions were granted to the Cambridge Housing Authority of Cambridge, MA for the purchase and installation of a Variable Refrigerant Volume (VRV) heat pump system and vent limited gas regulators for the Lyndon B. Johnson Apartments project.

Oct 28 - Notice of Submission of Proposed Information Collection to OMB Annual Progress Reports for Empowerment Zones

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. Correction: Due to the fact the 60 days had not expired (12/3/2011) 30 day sent early. The primary purpose of this collection is to continue current data reporting for Rounds, I, II, and III Empowerment Zones (EZs). HUD previously designated 30 EZs, which required to submit annual reports to HUD based on the progress reported in implementing the EZs' strategic plans. Businesses located in the EZs are eligible for Federal tax incentives to hire local residents and to expand or improve their operations. This is an extension of a currently approved collection.

Oct 27 - Statutorily Mandated Designation of Difficult Development Areas and Qualified Census Tracts for 2012

This document designates "Difficult Development Areas" (DDAs) for purposes of the Low-Income Housing Tax Credit (LIHTC) under Section 42 of the Internal Revenue Code of 1986 (IRC) (26 U.S.C. 42). The United States Department of Housing and Urban Development (HUD) makes new DDA designations annually. The designations of "Qualified Census Tracts" (QCTs) under IRC Section 42 published October 6, 2009, remain in effect. In addition to announcing the 2012 DDA designations, HUD seeks public comment on whether it should use Small Area Fair Market Rents (FMRs), rather than metropolitan-area FMRs, in future designations of metropolitan DDAs.

Oct 26 - Notice of Certain Operating Cost Adjustment Factors for 2012

This notice establishes operating cost adjustment factors (OCAFs) for project based assistance contracts for eligible multifamily housing projects having an anniversary date on or after February 11, 2012. OCAFs are annual factors used to adjust Section 8 rents renewed under section 524 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (MAHRA).

In accordance with section 102(a)(4)(C) of the Department of Housing and Urban Development Reform Act of 1989, this announcement notifies the public of funding decisions made by the Department for funding under the Notice of Funding Availability (NOFA) for the Limited English Proficiency Initiative (LEPI) Program for Fiscal Year (FY) 2010/2011. This announcement contains the names and addresses of those award recipients selected for funding based on the rating and ranking of all applications and the amount of the awards.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. This information is used to verify that a mortgage has been properly recorded and is eligible for FHA mortgage insurance.

Oct 26 - Notice of Submission of Proposed Information Collection to OMB, Multifamily Insurance Benefits Claims Package

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. When the terms of a Multifamily contract are breached or when a mortgagee meets conditions stated within the Multifamily contract for an automatic assignment, the holder of the mortgage may file for insurance benefits. To receive these benefits, the mortgagee must prepare and submit to HUD the Multifamily Insurance Benefits Claims Package. HUD uses the information collection to determine the insurance benefits owed to the mortgagee.

The proposed information collection requirement described below has been submitted to the Office of Management and Budget (OMB) for review, as required by the Paperwork Reduction Act. The Department is soliciting public comments on the subject proposal. HUD staff and Contract Administrators complete the form HUD-9834 during on-site reviews. The information gathered from the form is used to evaluate the quality of management, determine causes of problems, and devise corrective actions to safeguard the Department's financial interest and ensure that tenants are provided with decent, safe, and sanitary housing.

The Department is soliciting public comments on the subject proposal. Lenders provide information required to determine the eligibility of a mortgage to be insured under Section 513 of the Housing and Community Development Act of 1992 (Section 106 of the Energy Policy Act of 1992).

Oct 25 - Notice of a Project Waiver of Section 1605 (Buy American Requirement) of the American Recovery and Reinvestment Act of 2009 (ARRA) to the Borough of Ocean Gate, NJ

The EPA is hereby granting a project waiver of the Buy American requirements of ARRA Section 1605 under the authority of Section 1605(b)(2) [manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality] to the Borough of Ocean Gate, New Jersey (Borough), for the purchase of a foreign manufactured 50 kW wind turbine generator that meets the Borough's design and performance specifications. This is a project specific waiver and only applies to the use of the specified product for the ARRA project being proposed. Any other ARRA project that may wish to use the same product must apply for a separate waiver based on project specific circumstances. Based upon information submitted by the Borough and its consulting engineer, EPA has concluded that there are currently no domestic manufactured 50 kW wind turbines available in sufficient and reasonable quantity and of a satisfactory quality to meet the Borough's project design and performance specifications, and that a waiver is justified. The Regional Administrator is making this determination based on the review and recommendations of the State Revolving Fund Program Team. The Assistant Administrator of the Office of Administration and Resources Management has concurred on this decision to make an exception to Section 1605(a) of ARRA. This action permits the purchase of a foreign manufactured 50 kW wind turbine generator by the Borough, as specified in its June 6, 2011 waiver request.

The White House Campaign to Cut Waste announced important progress in the effort to rid the government of excess property. Last year, President Obama issued a Presidential Memorandum titled “Disposing of Unneeded Federal Real Estate” directing agencies to identify and dispose of $3 billion in excess real estate. Today, the Campaign to Cut Waste announced that the Administration is on track to exceed this goal – progress that will save the government $3.5 billion through sales, consolidations, cancelled projects, and other efforts to reduce maintenance and utility costs by the end of fiscal year 2012. As part of these efforts, the Campaign today officially labeled a multi-million dollar Georgetown property as excess, initiating the process to get it off the government’s books.

Oct 19 - New HUD Study Finds Moving to Low-Poverty Neighborhoods Lowers Risk of Obesity and Diabetes for Poor Women

Very-low income women who have the opportunity to move from high-poverty neighborhoods into lower poverty areas are significantly less likely to be extremely obese or to have diabetes. Those are among the key findings of a study by the U.S. Department of Housing and Urban Development. The U.S. Department of Housing and Urban Development today awarded $26.6 million in “sweat equity” grants to produce at least 1,477 affordable homes for low-income individuals and families. The U.S. Department of Housing and Urban Development announced today that it is charging a Philadelphia condominium association with violating the Fair Housing Act for refusing to revise its “no pets” policy as a reasonable accommodation for condominium residents with disabilities who required assistance animals. HUD's charge alleges that The Philadelphian Owners' Association (POA), which manages the 776-unit Philadelphian condominium complex, requiredthat residents provide burdensome and invasive medical documentation before requests for accommodation would be considered, severely limited access to the complex's facilities for residents accompanied by assistance animals, and failed to address several instances of harassment of residents requiring assistance animals.

This notice provides information to the public about the implementation of a point loss cap in the scoring process. This notice also proposes changes to definitions in the Dictionary of Deficiency Definitions that is an appendix to the PHAS notice on the physical condition scoring process. Oct 12 - HUD Suspends Former President of Lend America

The U.S. Department of Housing and Urban Development (HUD) today announced it is immediately suspending Michael Primeau, former President of Lend America, from doing any business with HUD following his admission that he engaged in a wide-scale mortgage fraud scheme. Specifically, Primeau pled guilty to charges he directed employees of Lend America, a former FHA-approved lender, to divert mortgage funds intended to pay off borrowers’ first mortgages at refinance closings in order to pay company operating expenses.

The U.S. Department of Housing and Urban Development (HUD) today announced it is charging a Park City, Utah homeowner association, property management company, and a group of condominium owners with violating the Fair Housing Act for refusing to accommodate a tenant who required an emotional support dog because of a disability. HUD brings the charges on behalf of the tenant, a Gulf War veteran with a disability.

Oct 11 - HUD Charges University of Nebraska at Kearney with Discriminating Against Student with Disabilities

The U.S. Department of Housing and Urban Development announced today that it is charging the University of Nebraska at Kearney and five of its employees with violating the Fair Housing Act when they refused to grant a student permission to have a therapy dog live in her University-owned apartment and illegally inquired into the nature and severity of the student’s disabilities. The student, who required the dog in order to cope with depression and anxiety, was seeking an exception to the University’s no-pet policy as a disability-related “reasonable accommodation” under the Fair Housing Act.

Oct 11 - Obama Administration Announces Selection of 14 Infrastructure Projects to be Expedited Through Permitting and Environmental Review Process

The Obama Administration announced the selection of 14 infrastructure projects around the country that will be expedited through permitting and environmental review processes, an important next step in the Administration’s efforts to improve the efficiency of federal reviews needed to help job-creating infrastructure projects move as quickly as possible from the drawing board to completion. This announcement comes as a result of the Presidential Memorandum. President Obama issued in late August at the recommendation of his Council on Jobs and Competitiveness. Through the Presidential Memorandum, the President directed agencies to expedite environmental reviews and permit decisions for a selection of high priority infrastructure projects that will create a significant number of jobs, have already identified necessary funding, and where the significant steps remaining before construction are within the control and jurisdiction of the federal government and can be completed within 18 months. Below is the full list of projects selected by those agencies, which represent diverse sectors of the economy and combined will support the creation of tens of thousands of jobs.

The U.S. Department of Housing and Urban Development (HUD) announced today that it is charging Metro Net Realty, LLC, a Queens, NY, real estate agency, and a salesperson for the agency with violating the Fair Housing Act by placing advertisements on Craigslist that discriminated against families with children. HUD brings the charge on behalf of the National Fair Housing Alliance (NFHA), alleging that the advertisements that stated “Looking For: Mature couple or single with no children” were evidence of an effort to exclude children from housing.

Oct 7 - Notice of a Regional Waiver of Section 1605 (Buy American Requirement) of the American Recovery and Reinvestment Act of 2009 (ARRA) to the City of Airway Heights (the City), Washington

The Regional Administrator of EPA Region 10 is hereby granting a waiver from the Buy American requirements of ARRA Section 1605(a) under the authority of Section 1605(b)(2) [manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality] to the City for the purchase of six Carrier split ductless air conditioning (AC) units, manufactured in Mexico and South Korea. This is a project specific waiver and only applies to the use of the specified products for the ARRA project being proposed. Any other ARRA recipient that wishes to use the same product must apply for a separate waiver based on project specific circumstances. The waiver applicant states that AC systems are required to provide a constant temperature for the electrical control room as part of the City’s project to upgrade of the wastewater treatment plant. The City’s consulting engineer requested the Carrier AC system products based on specifications on the project plans for six Carrier split ductless AC units. The City has provided sufficient documentation to support their request. This action allows the installation of the six specified ductless AC units as noted in the City’s June 22, 2011, request and additional follow up documentation.

The Regional Administrator of EPA Region 6 is hereby granting a project waiver of the Buy American requirements of ARRA Section 1605 under the authority of Section 1605(b)(2) (manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality) to the City of West Monroe (‘‘the City’’) for the purchase of the selected carbon steel pipe fittings and appurtenances (elbows, tees and flanges) to be incorporated in the Sparta Reuse Project—Waste Water Treatment Facility. The required carbon steel pipe fittings and appurtenances are manufactured by foreign manufacturers and no United States manufacturer produces an alternative that meets the City’s technical specifications. This is a project specific waiver and only applies to the use of the specified product for the ARRA funded project being proposed. Any other ARRA project that may wish to use the same product must apply for a separate waiver based on the specific project circumstances. The Regional Administrator is making this determination based on the review and recommendations of the EPA Region 6, Water Quality Protection Division. The City has provided sufficient documentation to support its request.

On May 1, 1998, the Federal Emergency Management Agency (FEMA) published a Notice of Proposed Rulemaking (NPRM) to revise the categories of projects eligible for funding under the Hazard Mitigation Grant Program (HMGP). The NPRM proposed to define eligible mitigation activities under the HMGP to include minor flood control projects that do not duplicate the efforts and authorities of other Federal agencies. It proposed to include vegetation management programs for wildfire hazard mitigation and erosion hazard mitigation in the list of eligible activities; it proposed to remove development or improvement of warning systems from the list of eligible project types; and modified language relating to general, allowable open space, recreational, and wetlands management uses. FEMA is withdrawing the NPRM so that relevant issues involved in the NPRM may be further considered and because portions of it are redundant or outdated.

Sep 30 - Final Fair Market Rents for the Housing Choice Voucher Program and Moderate Rehabilitation Single Room Occupancy Program Fiscal Year 2012; Notice

Section 8(c)(1) of the United States Housing Act of 1937 (USHA) requires the Secretary to publish FMRs periodically, but not less than annually, adjusted to be effective on October 1 of each year. The primary uses of FMRs are to determine payment standards for the Housing Choice Voucher (HCV) program, to determine initial renewal rents for some expiring project-based Section 8 contracts, to determine initial rents for housing assistance payment contracts in the Moderate Rehabilitation Single Room Occupancy program, and to serve as rent ceilings in the HOME program. Today's notice provides final FY 2012 FMRs for all areas that reflect the estimated 40th and 50th percentile rent levels trended to April 1, 2012. The FY 2012 FMRs are re- benchmarked using five-year, 2005-2009 data collected by the American Community Survey (ACS). These data are updated using one-year ACS data in areas where statistically valid one-year ACS data are available. The Consumer Price Index (CPI) rent and utility indexes are used to further update data from 2009 to the end of 2010.

Sep 29 - HUD Awards $600,000 to Expand Jobs and Training Opportunities for Low Income Residents

The U.S. Department of Housing and Urban Development today awarded $600,000 to increase hiring of low-income individuals and public housing residents. HUD is awarding twelve housing authorities, cities, and states $50,000 each to hire full-time Section 3 Program Coordinators for one year. These grants will maximize a HUD program that ensures HUD dollars are used to hire low-income individuals and to contract with businesses that hire them.

Sep 28 - HUD Charges Housing Providers With Discrimination For Evicting Tenants Over Visitor's Support Dog

HUD brings the charge on behalf of the tenants, alleging that the DeAngeli Family Trust and Peter DeAngeli, the respective owner and landlord of the property, engaged in unlawful discrimination by refusing to make a reasonable accommodation to the building’s “no pets policy” for a person with a disability. HUD also alleges the housing providers retaliated against the tenants by evicting them when they protested the housing providers' refusal to grant the accommodation.
